This supplement applies to business customers in United States. It forms part of the agreement with Lyndon Mukandavire trading as Cailub, alongside the Terms and Conditions, Privacy Policy and Data Processing Agreement. Where this supplement and those documents differ, this supplement applies for customers in United States.
1. Who this supplement applies to
Business customers established in the United States, excluding any state listed as excluded at checkout.
2. Who you are contracting with
Cailub is a trading name of Lyndon Mukandavire, a sole trader based in the United Kingdom at 60 Stockport Road, Manchester, M12 6AL, United Kingdom.
Wherever you are based, your contract is with this UK business. The UK GDPR applies to all of Cailub’s processing, the Information Commissioner’s Office (ICO) is our lead regulator, and prices are charged in pounds sterling (GBP). This supplement only adds the local rules that also apply in United States.
3. Rights that cannot be excluded
Nothing in our terms excludes liability that cannot be excluded under the law of your state.
4. Governing law and courts
These terms are governed by the law of England and Wales, subject to any rules of your state that cannot be varied by contract. The courts of England and Wales have jurisdiction over any dispute, unless mandatory law in your market gives you the right to bring proceedings locally.
5. Your privacy rights and the regulator
Where a state privacy law gives you rights over your personal information, such as the right to know, delete or correct it, or to opt out of its sale or sharing, you can use them by emailing us.
Cailub does not sell personal information and does not share it for cross-context behavioural advertising.
Regulator: Federal Trade Commission; The attorney general or privacy agency of the relevant state.
6. International data transfers
Where a business customer is covered by a state privacy law, the Data Processing Agreement includes service-provider terms: processing only on documented instructions, purpose limitation, no sale or sharing, deletion or return on exit, subprocessor controls, assistance and audit.
7. AI disclosure
Every Cailub chatbot tells users they are talking to an AI and never presents itself as a human. Customers cannot remove this notice.
Recruitment screening and automated hiring decisions are disabled.
8. Marketing
Business email under the CAN-SPAM Act: accurate sender details, an honest subject, a clear statement that the email is an advertisement, a postal address and an opt-out honoured promptly (always within 10 business days). Never to addresses on sites that say they do not want unsolicited email. Phone and text marketing stays disabled.
9. Tax
